Debts Recovery Tribunal Land Auction in Dharapuram, Tiruppur

SCHEDULE OF PROPERTY: Item No.1: Land admeasuring 1 Acre in Old SF No.1863/A, TS No.389, Kolathupalayam Village, Dharapuram Taluk, Tirupur District along with the building constructed/existing/to be constructed and all other improvements thereon, bounded on: East: Palaniappa Mudaliar and Others Land, West: Rukshana Begam's Land, North Dharapuram to Dindigul Road, South K. Selvakumari and others Land. (The above mentioned properties mortgaged by defendant No.01, 02 & 03 are covered under Original Registered Settlement Deed No.4559/2010, dated 23.04.2010 of SRO Dharapuram). Item No.2: Land admeasuring 1 Acre in Old SF No.1863/A, TS No.389, Kolathupalayam Village, Dharapuram Taluk, Tirupur District along with the building constructed/existing/to be constructed and all other improvements thereon, bounded on East: R.S.F. Nos.396, 398, West: Rukshana Begam's Land, North: Annamal's Land, South: East West Ittery. (The above mentioned properties mortgaged by defendant No.01, 02 & 03 are covered under Original Registered Settlement Deed No.861/2014, dated: 11.02.2014 of SRO Dharapuram & Original Registered Sale Deed No.1280/2006, dated: 29.03.2006 of SRO Dharapuram). As per Encumbrance Certificate dated 11.08.2026 for the period from 01.03.2006 to 04.08.2026, there is one attachment order No.IA 01/2025 in OS No.201/2025, dated: 13.02.2026 from Dharapuram Court is noted. However the same is subsequent to the mortgage of the scheduled property to the Bank. Encumbrance certificate of the schedule properties are available with the Nodal officer of the Bank mentioned below for inspection. Claims, if any, which have been put forward to the property, and any other known particulars bearing on its nature and value: No claim is pending before this Recovery Office. Further as per the order of Inspector General of Registration, Tamil Nadu in No.21343/C1/2021 dated 10.07.2021, even if any attachment by any civil court or other authority is there then still the Sub-registrar cannot refuse to register the sale certificate when the same is sold by DRT, in view of S.31-B of Recovery of Debts and Bankruptcy Act, 1993.
