KPHB Plot Auction EMD

Applicants participating in the Telangana Housing Board auction are required to deposit an Earnest Money Deposit (EMD) of ₹2 lakh , according to the auction notice.

The EMD is to be paid online through an e-Seva/Mee Seva centre . The notice says cash or cheque payments are not accepted. The EMD of the successful bidder will be adjusted towards the initial payment, while the EMD of unsuccessful bidders will be refunded to their respective accounts.

Important: One portion of the detailed terms contains a typographical inconsistency, mentioning “Rs. Twenty Five Lakhs” against the ₹2 lakh EMD figure. The main auction schedule and the notification table clearly specify ₹2,00,000 as the EMD . Prospective bidders should confirm the applicable EMD with the Telangana Housing Board before participating.

How Will the KPHB Auction Bidding Work?

Only participants willing to bid above the notified upset price will be permitted to participate.

The minimum bid increment is ₹2,000 per sq yard , although bidders can increase their bids by a higher amount. The auction officer will announce the highest bid for the third time before the bid is knocked down and declared final.

The terms also state that there is no fixed time limit for bidding , with the Auction Officer having discretion to continue, regulate, pause or conclude the bidding to ensure a free and fair auction.
A single bid will not be accepted , and the auction will be cancelled if at least three valid bids are not received. The Housing Board can also cancel the auction if it finds evidence of collusion, syndicate formation or any activity that affects a free and transparent auction.

Payment Rules for Successful KPHB Plot Bidders

The successful bidder will have to pay 25% of the bid amount , after adjustment of the EMD, along with 1% auction expenses , within five days from the date of auction.

If the required payment is not made within the stipulated period, the auction can be cancelled and the EMD forfeited.

After confirmation of the auction by the Vice-Chairman and Housing Commissioner, the remaining 75% of the bid amount has to be paid within the prescribed schedule.

The terms provide:

  • Within 30 days: Balance 75% can be paid without interest.
  • Within 60 days: Payment can be made with 12% annual interest , subject to the conditions specified in the auction terms.
  • Failure to complete payment within the prescribed period can result in forfeiture of the EMD and initial deposit .
  • A 2% rebate on the total bid amount is available if the entire sale consideration is paid within 30 days from confirmation of the auction.

Where Should KPHB Plot Auction Payments Be Made?

The Telangana Housing Board has specified that payments towards the plots must be made through the designated Virtual Account/Virtual ID created by Kotak Mahindra Bank under the Board's collection arrangement.

Payments made through cash, cheque or any account other than the designated Virtual Account will be treated as invalid and will not be recognised by the Telangana Housing Board.

Buyer Beware: KPHB Plots Offered on 'As Is Where Is' Basis

The auction notice contains a detailed Caveat Emptor or Buyer Beware clause .

The plots are being sold strictly on an “as is where is” basis . Prospective bidders are responsible for independently checking the property's:

  • Title
  • Extent and boundaries
  • Location
  • Access
  • Physical features
  • Zoning and land use
  • Encumbrances
  • Litigation, if any
  • Statutory compliance
  • Feasibility and suitability

The Housing Board advises bidders to inspect the plots and verify relevant records before participating .

The Board also states that successful bidders will be responsible for obtaining any required permissions, approvals, licences, sanctions, regularisations or conversions needed for their intended use of the plot.

When Will Ownership of the KPHB Plot Be Transferred?

Winning the auction does not by itself give the bidder legal ownership of the property.

According to the terms, ownership rights arise only after:

  1. The auction is confirmed by the Vice-Chairman and Housing Commissioner, Telangana Housing Board .
  2. The successful bidder pays the remaining 75% of the bid amount within the prescribed time.
  3. The Sale Deed is executed and registered in favour of the successful bidder.
  4. Physical possession of the plot is handed over.

The successful bidder will also have to bear stamp duty, registration charges, document preparation charges and other applicable registration-related expenses .

Can Multiple People Buy a KPHB Plot Together?

The auction terms allow joint participation. However, the names and complete details of all joint bidders must be provided before the auction process concludes.

No addition, deletion, substitution or alteration of bidder names will be allowed after the auction is concluded. The property will be registered jointly in the names of the approved joint bidders.

The document also specifies charges for certain changes involving joint bidders. Deletion of a joint bidder's name attracts a charge of ₹10,000 per name , while inclusion of eligible family members, subject to the stated conditions and approval, attracts ₹10,000 per name/member .
